  • Payment and Billing Information: Credit card or bank account details and billing address used to process payments.
  • Travel and Service Preferences: Any flight or travel preferences you provide (such as departure times, aircraft type, in-flight requests or Jet Card membership details).
  • Device and Usage Data: Technical details from your device and browser (e.g. IP address, device type, operating system, pages visited, and interaction data). This is collected via cookies and analytics tools to help us improve our services.
  • Other Information You Provide: Any additional information you choose to share (for example, comments in contact forms, survey responses, or profile details).

  • Fulfill Services: Process your charter bookings or Jet Card memberships, confirm your orders, arrange payments, and deliver the travel services you request.

Sharing with Third Parties

We do not sell your personal data. However, we share information with trusted partners as needed to provide our services:

  • Charter Operators and Travel Providers: We provide flight operators and other travel partners (airlines, ground transport, hotels, etc.) with the necessary passenger and itinerary details to arrange your bookings.
  • Payment and Financial Partners: We share payment and billing information securely with banks and payment processors so they can complete your transactions.
  • Service and IT Providers: Third-party vendors (such as website hosting, cloud storage, CRM/booking software, and analytics providers) process your data on our behalf. These partners are bound by contract to use your data only to help us run our services.

Terms of Use

These Terms of Use govern your access to and use of the Milford Jets website, mobile app and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any provision here, please do not use the Services.

Scope of Services

Milford Jets is a private jet charter brokerage, not an airline or aircraft operator. We arrange charter flights on your behalf by contracting with independent, licensed carriers. We do not own or operate any aircraft. All flights you book through Milford Jets are operated by third-party charter companies (“operators”) that meet or exceed applicable regulatory standards. When you reserve a flight, you enter into a contract directly with the aircraft operator, under that operator’s own terms. Milford Jets acts solely as your agent in arranging the flight. We are not a party to the carrier’s flight contract, and any claims or disputes about the actual flight performance are your responsibility with the operator.

  • Future Jet Card/Membership Programs: Milford Jets plans to introduce a Jet Card and membership program (prepaid flight hours or flight credits) in the future. When launched, that program will be subject to separate terms (to be provided at that time). Until then, all services you use are governed by these Terms.

User Eligibility and Obligations

  • Legal Age and Capacity: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If you use the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.
  • Use for Lawful Purposes: You agree to use the Services only in compliance with all applicable laws and regulations. You may not use Milford Jets or the Services for any unlawful or unauthorized purpose.
  • Accurate Information: You agree to provide complete and accurate information when using the Services. This includes your identity, contact details, payment information, and any documents (passport, visas, medical certificates, etc.) required for travel. You must keep your information updated. All information you submit must be truthful; you may not impersonate any person or submit false details.
  • Account Security: You are responsible for maintaining the confidentiality of any account credentials (passwords, account numbers) and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.
  • Restrictions on Conduct: You agree not to engage in prohibited conduct when using the Services. For example, you must not:
    • Infringe or violate any intellectual property rights, privacy rights or other legal rights of others.
    • Post or transmit any content that is unlawful, fraudulent, harassing, abusive, defamatory, obscene or otherwise objectionable.
    • Upload or introduce any malicious code (viruses, malware) or spam/disruptive messages.
    • Attempt to gain unauthorized access to our systems or interfere with the proper operation of the Services.

Any violation of these obligations may result in termination of your access and legal liability. You agree to comply with any additional rules or policies (e.g. carrier policies) that apply to the Services.

Booking and Cancellation Policies

  • Bookings: All charter bookings are subject to availability and Milford Jets’ acceptance. Rates quoted are estimates based on current availability and may be revised until your flight is confirmed. A full payment is generally required at booking. Charter prices typically include basic operating costs (fuel, crew, maintenance, standard catering, navigation, etc.), but exclude certain third-party fees. You are responsible for additional charges such as airport handling fees, crew overnight costs, taxes, and other applicable surcharges.
  • Cancellation Fees: If you cancel a confirmed charter, cancellation fees will apply. For example, industry practice (as reflected in other providers’ terms) is to charge a percentage of the total charter price based on how far in advance you cancel. A sample schedule is:
    • More than 6 days before departure: 25% of the charter fee.
    • 72 hours to 6 days before departure: 50% of the charter fee.
    • Less than 72 hours before departure: 100% of the charter fee (no refund).
    • Force Majeure: If cancellation is due to an unforeseeable, uncontrollable event (e.g. weather, government action), a smaller fee (e.g. 10%) may be charged.

Last-minute program changes or no-shows are typically treated the same as a cancellation under the above rules. Milford Jets reserves the right to apply a similar cancellation schedule. All cancellations and changes must be made in writing (email or through your account) and are effective when received by us.

  • No-Show/Refunds: If you fail to appear for the flight or cancel within the non- refundable period, you forfeit the amount paid. Any refunds (if applicable) will be processed according to the cancellation policy.

Jet Card and Membership Programs

Milford Jets plans to launch a Jet Card (prepaid hours) and membership program in the future. These programs will provide benefits like fixed hourly rates, priority booking or flight credits. Specific terms for these programs (eligibility, usage, billing, cancellation) will be published when the programs are offered. Until then, all bookings are governed by the standard charter terms above.

Intellectual Property

All content on the Milford Jets website and app (including text, images, icons, logos, and software) is owned by Milford Jets or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to access and use the content only as necessary to use the Services (e.g. to view aircraft descriptions, make bookings, etc.). Any other use (copying, reproducing, distributing, modifying, or publicly displaying content) is strictly prohibited without our express permission. The “Milford Jets” name and logo (and other marks on the site) are our trademarks; their display does not grant you any rights to use them. Use of any third-party trademarks on our site (e.g. aircraft or service brands) is for identification only and does not imply any endorsement.

Data and Privacy

We respect your privacy and handle your personal data according to applicable law and our Privacy Policy (see link below). In order to arrange charters, we may collect personal information such as your name, contact details, passport and visa information, health details (when required), and payment information. We use this data to process your booking, to comply with safety and regulatory requirements, and to provide the Services. By using Milford Jets, you consent to this collection and use of your data.

Our website also uses cookies and collects technical data (IP address, device and usage information) to improve functionality. We will protect your data in compliance with relevant laws (e.g. India’s IT Act and data protection rules). For details on data handling, retention and your rights (access, correction, deletion, etc.), please review our Privacy Policy. Your use of our Services signifies that you agree to Milford Jets’ Privacy Policy and data practices.

Limitation of Liability

To the maximum extent permitted by law, neither Milford Jets nor its affiliates, employees or agents will be liable for any indirect, special, incidental, consequential or punitive damages arising out of your use of the Services. This includes, without limitation, loss of profits, loss of data, or loss of use of any equipment or services. Our liability for any claim arising under these Terms is strictly limited to the total amount you paid for the chartered flight.

No Warranty

The Services (including all website content and bookings) are provided “AS IS”. We make no representations or warranties (express or implied) about accuracy, completeness, or reliability of any information. As noted in other private charter terms, we assume “no liability or responsibility for any error or omissions in the information contained in the Services”. We do not guarantee that the Services will be uninterrupted or error-free, and we are not responsible for technical failures beyond our control.

In particular, because Milford Jets is only a broker, any liabilities for the operation of the aircraft (safety, delays, loss or damage during flight, etc.) are those of the carrier. We are not responsible for the operator’s performance. We are not a party to any agreements … with any such provider and any recourse you may have is solely against the provider and not against us.

Indemnification

You agree to indemnify and hold harmless Milford Jets and its officers, directors, employees and agents from and against any claims, demands, losses, liabilities, damages, or expenses (including legal fees) arising out of or related to your use of the Services or your breach of these Terms. This includes claims related to your violation of law, misuse of content, or any negligent or willful act by you in connection with the Services.

Legal Compliance

You agree not to use the services for any illegal or unauthorized purpose. You must comply with all laws and regulations (including immigration, customs, and tax laws) related to your travel. You will not assist any others in violating these laws. You are solely responsible for all customs declarations, permits, and licenses for people or goods transported.

Safe Conduct

You agree to follow all instructions from the aircraft operator and crew concerning safety and security. You may not carry illegal or hazardous items, and you agree to comply with inspections or searches as required by law. Milford Jets will not be liable for any injuries or losses resulting from your failure to comply with safety requirements.

Truthful Information

You must provide complete, accurate, and current information about yourself and any passengers (including names, citizenship, travel documents, and payment information). You are responsible for maintaining the confidentiality of your account credentials.

Governing Law

These Terms are governed by and shall be construed in accordance with the laws of India, without regard to conflict of law principles. As with other India-based charter providers, any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts in Mumbai. However, before resorting to litigation, we require that any claim or dispute be submitted to binding arbitration.

Dispute Resolution and Arbitration

To the fullest extent allowed by applicable law, any dispute between you and Milford Jets relating to these Terms will be resolved by final and binding arbitration in Mumbai, India (conducted in English) under the Arbitration and Conciliation Act, 1996. You and we waive any right to a trial by jury or to participate in a class action. (Note: if Indian law or a regulatory authority limits arbitration in certain cases, those provisions shall prevail. Otherwise, arbitration is mandatory.)

Changes to Terms

Milford Jets may modify these Terms at any time. We will post any revised Terms on our website (and may also notify you by email or in the app). The updated Terms take effect upon posting. Your continued use of the Services after such updates means you accept and agree to the new Terms. If you do not agree to a change, you must stop using the Services immediately.

Acceptance

By using Milford Jets’ website or app, you acknowledge that you have read and understood these Terms and agree to be bound by them and all incorporated policies. If there is any conflict between these Terms and additional terms (for example, specific program terms or carrier terms), the additional terms will apply to that specific service as indicated.
